These Residential Voice Service Terms & Conditions (“Terms”) govern residential telephone service provided by PhoneAll Cloud LLC (“PhoneAll Cloud,” “we,” “us,” or “our”). By enrolling in, activating, or using PhoneAll Cloud residential voice service (“Service”), the customer (“Resident,” “Customer,” “you,” or “your”) agrees to these Terms.

1. RESIDENTIAL VOICE SERVICE

PhoneAll Cloud provides residential voice-over-internet-protocol (“VoIP”) telephone service. Service may be provided through an analog telephone adapter (“ATA”), SIP gateway, IP telephone, or other compatible equipment connected to an Internet or facility network.

Depending on the property and installation, residents may continue using an existing analog telephone connected to PhoneAll-provided or facility equipment.

PhoneAll Cloud LLC provides the telephone/communications service. PhoneAll Inc may provide onsite installation, equipment setup, maintenance, and technical support.

2. SERVICE CHARGES

Service charges will be stated on the applicable enrollment form, service order, agreement, or other written offer provided to the Customer.

Applicable taxes, government assessments, regulatory fees, or other legally required charges may be added where required.

Unless otherwise stated in writing, residential Service is provided on a month-to-month basis.

3. BILLING AUTHORIZATION

By enrolling in Service and providing a payment method, you authorize PhoneAll Cloud to charge the applicable recurring service charges, taxes, fees, and other authorized charges to the payment method provided.

You are responsible for keeping your billing and contact information current.

If payment cannot be processed, PhoneAll Cloud may contact you to update your payment information. Service may be suspended or discontinued for unpaid balances after any notices required by applicable law.

4. KEEPING YOUR EXISTING TELEPHONE NUMBER

If you request to keep an existing telephone number, you authorize PhoneAll Cloud and its underlying telecommunications providers to submit and process the information necessary to transfer (“port”) that telephone number to PhoneAll Cloud's service.

You represent that you are authorized to request the transfer of the telephone number.

Number transfers are subject to carrier availability, accurate account information, and applicable telecommunications requirements. PhoneAll Cloud cannot guarantee a particular completion date until the transfer has been accepted by the applicable carriers.

Do not cancel your existing telephone service before your number transfer is completed unless instructed to do so.

5. EQUIPMENT

Service may operate through PhoneAll-provided equipment, facility equipment, an analog telephone adapter (“ATA”), SIP gateway, IP telephone, or other compatible telecommunications equipment.

Any equipment provided by PhoneAll Cloud or PhoneAll Inc remains subject to the ownership terms communicated at enrollment or installation.

Residents should not intentionally disconnect, modify, reset, relocate, or damage PhoneAll-owned equipment.

Lost, damaged, or unreturned PhoneAll-owned equipment may be subject to reasonable replacement charges.

6. SERVICE AND MAINTENANCE

PhoneAll will provide reasonable technical support for the telephone service and PhoneAll-provided equipment.

Where onsite support is included, PhoneAll Inc may provide onsite installation, troubleshooting, equipment replacement, and related support on behalf of or in coordination with PhoneAll Cloud.

Problems caused by a resident's personal equipment, facility network, Internet provider, electrical service, building wiring, or circumstances outside PhoneAll's control may require coordination with the appropriate third party.

7. TELEPHONE NUMBERS

Telephone numbers are subject to applicable carrier and regulatory requirements.

PhoneAll Cloud will make reasonable efforts to maintain your assigned or transferred telephone number while your Service remains active, but continued availability of a particular number cannot be guaranteed in every circumstance.

If you discontinue PhoneAll Cloud Service and wish to transfer your number to another provider, you should begin the porting process with the new provider before disconnecting your PhoneAll Cloud Service.

8. ACCEPTABLE USE

Residential Service is intended for normal personal residential telephone use.

You may not use the Service for unlawful purposes, harassment, fraud, abusive calling, unauthorized automated calling, or any activity prohibited by applicable law.

PhoneAll Cloud may restrict or discontinue Service being used unlawfully or in a manner that threatens the operation or security of its network or services, subject to applicable law.

9. SERVICE AVAILABILITY

PhoneAll Cloud works to provide reliable telephone service but cannot guarantee uninterrupted or error-free operation.

Temporary interruptions may occur because of maintenance, Internet outages, power failures, carrier outages, equipment failures, emergencies, facility-network issues, or circumstances outside PhoneAll Cloud's reasonable control.

10. POWER AND INTERNET DEPENDENCY

PhoneAll Cloud residential voice service uses VoIP technology and requires functioning telecommunications equipment, electrical power, and network connectivity.

Unlike some traditional copper telephone services, Service may not work during a building power outage, Internet outage, network failure, equipment failure, maintenance event, or other interruption.

Battery backup equipment, if present, may provide temporary operation but does not guarantee continuous telephone service.

11. 911 AND EMERGENCY CALLING

IMPORTANT 911 INFORMATION: PhoneAll Cloud's residential telephone service uses VoIP technology and does not operate exactly like a traditional copper telephone line.

911/E911 service depends on the address registered for your telephone service. You agree to provide an accurate service location and notify PhoneAll Cloud if the telephone or Service is permanently moved to another location.

When calling 911, you should be prepared to provide your name, current location, and telephone number to the emergency operator.

911/E911 calling may be unavailable or impaired during circumstances including a power outage, Internet or facility-network outage, equipment failure or disconnection, suspension or termination of Service, or use of the telephone from a location different from its registered service address.

If PhoneAll Cloud telephone service is unavailable during an emergency, residents should use another available method to contact emergency services, such as a mobile telephone or facility emergency system.

12. LIMITATION OF SERVICE

PhoneAll Cloud is not responsible for interruptions or failures caused by circumstances outside its reasonable control, including Internet-provider outages, electrical outages, facility-network failures, natural disasters, third-party carrier failures, or customer-owned equipment.

Nothing in these Terms limits any rights or remedies that cannot legally be waived or limited under applicable law.

13. CHANGES TO SERVICE OR TERMS

PhoneAll Cloud may update these Terms or Service features from time to time, subject to applicable law and any legally required notice.

Current Residential Voice Service Terms will be made available through PhoneAll.

14. CANCELLATION

Unless otherwise stated in writing, residential Service is month-to-month.

Customers may cancel Service by contacting PhoneAll. Charges incurred before the effective cancellation date remain the Customer's responsibility.

If you intend to transfer your telephone number to another provider, initiate the number transfer before requesting cancellation.

Any PhoneAll-owned equipment that must be returned should be returned according to instructions provided by PhoneAll.

CUSTOMER ACKNOWLEDGMENT
By submitting an enrollment form, electronically accepting these Terms, or activating and using the Service, you acknowledge that you have reviewed and agree to these Residential Voice Service Terms & Conditions.
